McCoy was arrested on a circuit court warrant issued July 20. Stata was killed on the afternoon of March 17, when she was riding as a passenger in a 1998 Ford Explorer being driven by Melissa Stephenson, then 26, also of Cheyenne. Stephenson was traveling eastbound on Randall Avenue, while McCoy was traveling northbound on O'Neil Avenue in a 2000 Ford F-250 pickup truck. At about 5:09 p. m. , McCoy failed to stop for a stop sign at Randall Avenue, though he did hit his brakes, leaving 65 feet of skid marks going past the stop sign and into the intersection. McCoy's truck collided with the rear passenger side of Stephenson's vehicle, causing the Explorer to rotate clockwise. Looking to her right, she said she saw a big truck bearing down on her, and the truck did not stop for the stop sign. On April 8, McCoy told police he did stop at the stop sign, looked both ways and then proceeded slowly into the intersection when Stephenson's Explorer "came out of nowhere.
