A majority opinion from the state's 1st Circuit Court of Appeal Monday upheld a ruling dismissing civil charges against Adele Dantin, owner of a Nissan Maxima involved in killing of Thibodaux veterinarian Kristofor "K. C. " Toups in 2011. Baton... Toups was driving on La. 1 north of Raceland transporting animals to south Lafourche when his truck was rear-ended by the Nissan Maxima driven by James Dantin. James Dantin, who police said was speeding and was under the influence of illegal drugs, was sentenced to 30 years in prison after he pleaded guilty to vehicular homicide in January 2012. Later that month, Toups' parents filed a lawsuit for... Toups' parents alleged Adele Dantin knew her husband was prohibited from driving a vehicle without an ignition interlock device but allowed him to use the Maxima, which did not have the equipment. Adele Dantin argued there was no evidence that she gave her husband permission to drive the Maxima at the time of the accident.
