Merrill Police and Fire Commission member David Hayes is charged with two felonies involving the sexual molestation of a child, according to Lincoln County court records. Hayes, 46, of Merrill is charged in Lincoln County court with second-degree sexual assault with use of force and having sex with a child 16 years old or older, according to court records. Hayes' initial court appearance will be before a substitute judge when one is assigned, according to records of the court hearing. Court records accuse Hayes in two separate incidents involving the same teen, one in August 2012 and another in August 2014. When he was interviewed, Hayes told police he was a member of the city's Police and Fire Commission, a body charged with overseeing the discipline, hiring and firing of police officers, among other duties. She was the only passenger in the Ford F150 pickup truck when Hayes was driving her home from the event between 1 a. m. and 2 a. m. and he stopped in a field, according to court documents.
