NHTSA Slams Fiat Chrysler For Handling Of Recalls: What Does That Mean For You? - The Car Connection

Last week, representatives from the Fiat Chrysler Automobiles (FCA) were summoned to Washington, D. C. , to explain the way that they'd handled recalls over the past couple of years. According to Automotive News — and to official hearing testimonies — things didn't go so well for FCA. In a nutshell, NHTSA wanted to know whether FCA followed U. S. regulations with regard to 23 recent recalls. All told, those recalls have affected over 11 million vehicles from coast to coast since 2013. Is FCA the only automaker that bends NHTSA's rules. During the hearing, Scott Yon with NHTSA's Office of Defects Investigation noted that FCA seems to suffer from a unique set of internal problems. For example, he noted that FCA has trouble getting repair/replacement parts for recalled vehicles, and that dealers, in turn, have trouble getting those parts from FCA. In response, FCA's Scott Kunselman said that, yes, the automaker could've done better in those 23 instances. He assured NHTSA that FCA was working to revamp its internal processes to meet best practices in the industry. Takata Defiant Before Congress, But Says It's Ditching Volatile Ammonium ... - The Car Connection

Auto News reports that in a recent appearance before members of Congress, representatives from the Japanese parts supplier defended their actions in the wake of the ongoing recall fiasco, but also said that they were taking steps to change... The company's troubles began several years ago, as the National Highway Traffic Safety Administration and automakers began receiving reports of Takata airbags exploding upon deployment. Investigations are ongoing, but at this point it seems clear that the problem with Takata's airbags is moisture and the way that it affects the devices' propellant, ammonium nitrate. Moisture can cause that compound to degrade over time, rendering it highly unstable, and unstable ammonium nitrate can lead to disaster. During testimony before a subcommittee in the U. S. House of Representatives, Takata's Kevin Kennedy insisted that ammonium nitrate is not dangerous when it is properly manufactured. That point was illustrated by Kennedy's admission that Takata has for some time mixed much of its ammonium nitrate with a desiccant to absorb moisture and prevent the compound from destabilization. In their opinion, consumers simply rent vehicles -- or at least parts of them -- for extended periods of time. Ultimately, those parts remain the property of the manufacturer. It all comes down to software, the Digital Millennium Copyright Act, and the rights that the DMCA affords manufacturers and their goods. General Motors, for example, says that it retains ownership of the software that helps run its vehicles. Folks who own GM cars and trucks can tinker and tune all they like, but they're not allowed to touch the software. They don't own GM's code like they own the tires, steering wheel, or engine. That's put many farmers in a bind, because they can't afford the cost of diagnostic software necessary to repair their expensive, high-tech harvesters. As author Kyle Wiens puts it, " In other words, there may -- may -- be some merit to the argument that mobile phone software shouldn't be touched because the device that uses it is semi-disposable. In that view, users shouldn't be able to tinker with the phone's software because the device is meant to be replaced as next-gen software rolls out.
