The Chattanooga Police Department has issued a capias for the arrest of Benjamin Brewer, 39, concerning the multiple fatality traffic crash that occurred on I-75 northbound on June 25. Brewer was indicted on Monday on 13 counts. and one count for false reports of duty status, a misdemeanor. A preliminary report from the National Transportation Safety Board on the wreck at the Ooltewah exit said the driver of the truck that caused the multiple-vehicle wreck "had exceeded the Federal Motor Carrier Safety Regulation hours-of-service... It said Brewer began his return trip to London, Ky. , from Florida at 4:30 a. m. that day and was still behind the wheel at the time of the 7:10 p. m. crash in Chattanooga. It also said that Brewer was on duty for about 50 consecutive hours en route to Florida, where he had a minor accident involving sideswiping another tractor-trailer. The report says at the time of the wreck that traffic was stopped in the left lane and moving slowly in the center and right lanes due to a construction project and land closures ahead.
