Judge sides with officers in suit alleging they mocked double amputee - Lincoln Journal Star

District Judge Richard Kopf granted the city's request for summary judgment in the lawsuit brought by Leroy Duffie, ending the case without a full trial. Duffie failed to establish that police had violated his constitutional rights, Kopf wrote in his order. "There is no evidence that the officers intended to cause harm to Duffie that was unrelated to the investigative stop, nor is there evidence that the defendants abused their power in a 'brutal' and 'offensive' way," Kopf said. 3, 2011, the officers were looking for a suspect who had brandished a handgun in a convenience store, then fled in a vehicle similar to Duffie’s 1998 Chevrolet Astro van, according to the city. They pulled Duffie, then 58, over as he was heading south on 27th Street around 10:30 p. m. Several officers flanked the van and ordered Duffie at gunpoint to get out with his hands up. Duffie rolled his window down and told them he couldn’t get... The ground knocked Duffie’s teeth out and caused a tear in his rotator cuff, the lawsuit said. Officers then handcuffed Duffie and left him on the ground for several minutes, while they searched the car. Source: journalstar.com
