Warren County loses road collapse lawsuit - Glens Falls Post-Star

The county was sued by the driver who was hurt when county Route 19 in Pottersville, also known as Olmstedville Road, washed out beneath her sport-utility vehicle after a heavy rainstorm. A beaver dam in an area upstream of Fish Brook washed out, pitching Diane McDonald and her Toyota RAV4 into the swollen stream. McDonald and Steven Colletti, identified in court records as McDonald’s husband, filed a lawsuit in 2007, claiming the county was negligent in design and construction of culverts and the road. A non-jury trial was held before state Supreme Court Justice David Krogmann, who ruled against the county and found it liable. Krogmann also recently denied a request by the county’s lawyers, Glens Falls firm Fitzgerald Morris Baker Firth PC, to overturn the verdict. The lawsuit stemmed from the county’s actions in rebuilding the road and culverts following a 1989 dam collapse upstream of the road, which also damaged it.
