LOS ANGELES (Legal Newsline) – A class action lawsuit seeks restitution for an apparently faulty transmission in some recent models of the Nissan Pathfinder. According to a lawsuit filed on March 30 in Los Angeles County Superior Court, Gerardo Torres and Angela Matlin are leading a class action complaint against Nissan North America Inc, Nissan Motor Co. Ltd. Nissan removed the case to U. S. District Court for the Central District of California on April 30 under the Class Action Fairness Act. The lawsuit states that the defendants portrayed CVT as a way to satisfy buyers' desire for more efficiency while maintaining the horsepower from previous models and having an engine that could achieve "the ideal rpm for the conditions at hand,... Ultimately, the lawsuit states, the class action was brought because the transmissions had flaws that were causing "shaking, juddering, jerking, delayed acceleration and, eventually, transmission failure. Now we have our answer: The Pathfinder Hybrid "is no longer available," according to the Nissan website--nor is its Infiniti QX60 Hybrid sibling. Still, the departure of Pathfinder Hybrid after a single model year is unusual--even if Green Car Reports, among others, found that the vehicle failed to meet its 26-mpg combined EPA rating during a lengthy real-world winter test. (The V-6 Pathfinder comes in at 21 mpg combined with all-wheel drive, 22 mpg with front-wheel drive. We asked Nissan for a Pathfinder Hybrid last summer to repeat the test in warmer weather, which is usually kinder to hybrid fuel efficiency, but the company declined to make one available.
